Scape Construction framework -- Scotland
Notice Description
Scape Procure Scotland Ltd (Scape) has to established a framework agreement for a 4-year duration with an option to extend for a further 2 years, for use by or on behalf of public sector bodies (and their respective statutory successors and organisations created as a result of re-organisations or organisational changes). Applications were invited from experienced providers of Construction works and services who can provide high quality works and services as defined defined by the NUTS and CPV codes below using a customer focused approach, particularly in the public sector. The works and services will be provided by the provider themselves, through their supply chain or via a consortium/joint venture arrangement. The opportunity was divided into four (4) lots. This Framework Agreement will be accessible for use by public sector bodies (their statutory successors), corporations established, or a group of individuals appointed to act together as defined by Part 1 of the Public Contracts (Scotland) Regulations 2015 or cited by name in Schedule 1 to the Public Contracts (Scotland) Regulations 2015 and online at: https://www.scapegroup.co.uk/site-information/framework-usage-eligibility

Lot 1 - Lower 0 - 10m GBP
Note: This is a Modification Notice. The opportunity has already been awarded. The description was originally published in the Contract Notice Publication reference: 2020/S 193-467831. The CPV codes used within the original notice still apply. This modification notice is issued solely as confirmation that the 24-month extension to the Framework duration has been utilised by SCAPE.
Lot 2 - Lower 0 - 10m GBPNote: This is a Modification Notice. The opportunity has already been awarded. The description was originally published in the Contract Notice Publication reference: 2020/S 193-467831. The CPV codes used within the original notice still apply. The only modification this notice introduces is the value band range changing from 0 - 7.5m GBP to the new range of 0 - 10m GBP.
Lot 3 - Upper 7.5m GBP plusScape Procure Scotland Ltd was open to receiving responses from consortia, joint ventures, strategic alliances and other such arrangements, however such organisations were required to form a single entity to contract with prior to the award of the contract and provide appropriate guarantees and security packages commensurate with the works/services. The specific works and services that may be procured under the framework cannot be clearly defined at this stage, however the nature and types of works that may be required may include those services identified by CPV code on or in connection with any land or property and related asset owned, rented, leased or developed by any of the public sector bodies eligible to use the Framework or on property or related assets in which any of the public sector bodies may have an interest at the time or prospectively and may include projects in the following sectors, amongst others:-- education, housing, social care, leisure, libraries, blue light, health and social care, offices, transport, military, farms, recycling and waste centres, industrial and commercial buildings and other public sector operational buildings and establishments. The provider will be expected to work closely and cooperate with local government and other contracting authorities, in-house and external design consultants, contractors and other partner providers. All contract performance will be monitored using a set of comprehensive performance indicators.. Some call-offs from this framework may be subject to the European Structural Investment Fund (ESIF) comprising the European Regional Development Fund (ERDF), the European Social Fund in Scotland (ESF) and the Rural Development Programme for Scotland (SRDP). Therefore, the service provider will need to comply with the funding requirements of the European Structural Investment Fund (ESIF).

This opportunity is divided into four (4) lots and potential suppliers MUST indicate which lot or lots they intend bidding for and whether bidding as a single entity or as part of a consortia arrangement. Bidders need only complete one (1) PQQ for each value band, which will then be considered for both lots within that value band. The evaluation process will ensure only the top five (5) highest scoring compliant bidders in each value band will be invited to respond to the ITT. -

Any such action must be brought within 30 days from the date when the economic operator in question first knew or ought to have known that grounds for the bringing of proceedings had arisen. The Court may extend the 30-day period in a particular case if it considers that there is good reason for so doing, up to a period of 3 months from the actual or deemed date of knowledge of the economic operator. The Court may order the setting aside of the award decision or may order the contracting authority to amend any document and may award damages. If the framework agreement has been entered into the Court may make a declaration of ineffectiveness or may order that the duration of any relevant specific contract be shortened and additionally may award damages. The time limit for seeking such a declaration is generally 30 days from notification of The award (either by award decision notification or contract award notice depending on the circumstances) or otherwise 6 months. Proceedings may be instigated by the issue of a claim form meeting the requirements of the Court Procedure Rules ('CPR') within 30 days from when the relevant economic operator first knew or ought to have known that grounds for proceedings had arisen.",
