In 2005 LBSL awarded a 10-year contract to Siemens for the bus communication system known as iBus (the Contract). The Contract was novated to Trapeze in October 2009, when Trapeze purchased the relevant business. Since the original procurement, there have been additional modifications. Please see the description given at section II.2.4 above for further details of the Contract. The Variation will include licenses for the further System and Service Charge (support) of TfL's bespoke Legacy LRD. The Legacy LRD is included in the original scope of the Contract; however, the further support services provided via this Variation are not. The LRD is a business-critical component of iBus, used for Operational Reports including payments to Bus Operating Companies. The Legacy LRD requires further ongoing support to facilitate the necessary reporting and payments to Bus Operators and to assist with the transition to iBus2. The Variation will be on the Contract's existing terms. Please see the description given at section VII.2.1 below for further details of the modifications associated with the Variation.

"description": "As explained in section II.2.4 above, in 2005 LBSL (a subsidiary of TfL) awarded a 10-year contract to Siemens for the bus communication system known as iBus (the Contract). The Contract was novated to Trapeze in October 2009, when Trapeze purchased the relevant business. In 2015, the parties agreed to extend the Contract from May 2015 for up to 7 years, such that it would terminate in May 2022. TfL is competitively procuring the next generation system, iBus2, under the Public Contracts Regulations 2015 (PCR). The iBus2 procurement comprises two lots: the on-bus systems and the back-office systems (Trapeze currently provides the equivalent of both of these services under the Contract). Earlier in 2022, LBSL and Trapeze agreed to extend the Contract for a period of up to a further 5 years until May 2027 in order to allow for completion of the iBus2 procurement and an orderly and low-risk transition to the resulting new arrangements (see Modification Notices 2022/S 000-011568 and 2022/S 000-017432 for further details). TfL and Trapeze agreed to a variation of the iBus contract, specifically CCN671 to provide further support to TfL's existing Legacy London Reporting Database (LRD) (\"Variation\"). This modification notice relates to that Variation. LBSL considers that the Variation benefits from the exemption for \"additional services\" that is laid down in Regulation 72(1)(b) of the PCR. The LRD is an existing service within the iBus contract. The provision of additional legacy System Support to the LRD has become necessary for LBSL to ensure continuation of the Operational Reporting while the procurement of iBus2 is completed. Once iBus2 is in place the Operational Reports will be provided via a Data feed from the new LRD into iBus2. Although, a New LRD system exists which is also provided by Trapeze, it does not provide all of the necessary reporting required under the Contract. Therefore, the additional support is needed to keep the Legacy LRD running alongside the New LRD to deliver these reports. The continued ongoing support to the LRD will enable a low-risk transition to the new LRD and iBus2 services. As noted above, the legacy LRD is required to provide Bus Operator Operational Reports until the iBus2 services are in place because the new LRD does not provide sufficient reporting capabilities. Once completed, LBSL will be able to turn off the Legacy LRD and it will be descoped from the iBus contract. For more details of the reasons, please see section VII.2.2 below.",
"rationale": "Need for additional works, services or supplies by the original contractor/concessionaire: Due to the proprietary nature of the LRD, it isn't possible for another contractor to provide the support services to the Legacy LRD. Additionally, given the complexity of the iBus system including the bespoke Legacy LRD service which has been created by Trapeze, it is not feasible for LBSL to procure a different contractor to support its out of support bespoke LRD in a way that safeguards the continued operation of LBSL's iBus (and wider bus) services. LBSL has concerns relating to the interoperability of any new LRD solution that includes Operational Reporting. Because the LRD is bespoke, including its RS layer, the required support and reporting can only be provided by the current Supplier. This modification will mitigate significant risks to operational services. Without these services LBSL performance reporting may be inaccurate, which may have significant financial implications for LSBL. Specifically, the Variation will enable. LBSL to continue to monitor, manage and report on bus services across London until the current iBus contract end date, which could potentially be 4 May 2027."
