Procurement Information

The basis for Disclosure Scotland's use of the negotiated procedure without prior publication of a contract notice is extreme urgency brought about by events unforeseeable by Disclosure Scotland. Disclosure Scotland awarded a call-off contract to an incoming economic operator, under a framework set up in accordance with Directive 2004/18/EC, and faced unforeseen circumstances that prevented completion of that contract. Since service mobilisation and delivery by that incoming economic operator could not take place, an emergency contract was awarded in 2015. This award is made to the same contractor whom was awarded a contract under the extreme urgency provision in 2015 as a short extension to that contract to allow continuation of a critical public service. (being the only economic operator able to maintain service continuity) until the new replacement contract commences (expected September 2018). Disclosure Scotland faced extremely grave jeopardy in terms of the potential failure of business critical operations beyond 29th April 2015, which required to be provided to the public without fail on a continuing basis. The contract awarded is appropriately limited in duration having regard for the urgency. A fresh and compliant procurement has been run to replace this emergency contract but due to some minor unforeseen delays it has been necessary to extend the current arrangement to ensure a seamless transfer from the old IT system to the newly designed IT system.
