Protect Framework (Compliance Services)
Notice Description
This procurement relates to the establishment of a framework for the provision of various compliance services across the property and housing sector. The framework is designed to support Hyde Housing Association (Hyde) and other public sector bodies in accessing high-quality services to deliver their compliance servicing, maintenance and installation programmes. The framework will offer services regionally and nationally, with an estimated value of PS2,688,000,000 exc VAT (PS3,225,600,000 inc VAT) over its possible six-year term (an initial term of four years with the option to extend for a further two years). Individual framework lots will have anticipated values, but all lots will draw from the single aggregate total framework value. All values shown are estimates only and do not guarantee expenditure. Call-off contracts awarded under this framework may be extended beyond the initial contract term. The maximum duration of any individual call-off contract, including any extensions, shall not exceed 15 years. The Authorised Users may exercise the right to extend at their sole discretion, provided that written notice is given to the Framework Supplier no later than 3 months prior to the expiry of the then-current term. Extensions are subject to satisfactory performance, continued need, and budgetary approval. The framework consists of 141 lots covering specific workstreams across four regional areas (Region 1. London, South East and East of England, Region 2. South Wales and the South West, Region 3. East and West Midlands, Region 4. North Wales and the North of England) and a national region (Region 5). For each workstream, bidder are able to bid for a combination of regional lots or the national lot. The framework will be accessible nationally and will allow for both award without further competition, formerly direct award and competitive selection process, formerly mini competition under the Open Procedure, in accordance with the Procurement Act 2023 and associated Regulations and will be open to all UK public sector bodies (and others as detailed in the procurement documents and in the description below) to access via an Access Agreement between Hyde, the Supplier and Pretium Frameworks Ltd, who Hyde has appointed to administer the framework on their behalf. Pretium will act as the agent, as per the Procurement Act 23. Full details of the scope and requirements of the framework and the procurement process, including how to tender are included within the procurement and tender documents. Hyde anticipate appointing ten suppliers to each individual workstream lot (per region), and twelve suppliers to each national workstream lot, but reserve the right to adjust these numbers at their discretion as set out in the procurement documents, specifically the Lot Bidding Form. The Contracting Authority reserves the right to cancel the procurement and not to proceed with all or any part of the Framework at any stage of the procurement process. The Contracting Authority also reserves the right not to award the Framework. Neither the Contracting Authority nor any person on whose behalf of whom this procurement is undertaken is to be liable for any costs incurred by those expressing an interest or Tendering for this Framework. The Contracting Authority considers that this contract may be suitable for economic operators that are Small or Medium Enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement. It should be noted that neither Devonshires, Pretium or Echelon shall be responsible for any changes made to the documents without the approval or engagement of the authors of the relevant documents at or prior to call off stage. The framework will be open to but not limited to any "Authorised User", which is defined as follows: Authorised User" means any of the following: (i) any entity within the same group of companies as Hyde from time to time (a "Hyde Group Member"); (ii) any entity or joint venture company that Hyde or any other Hyde Member holds an interest in from time to time (a "Hyde JV"); (iii) any provider in the UK Housing Sector (including Local Authorities, Registered Providers and any members of their supply chain including Direct Labour Organisations and Suppliers), Any other "contracting authority" in the UK as defined in the Procurement Act 2023 Any Body that has to comply with the Procurement Act 2023 or Public Contracts Regulations Scotland, Educational establishments, including but not limited to; primary and secondary schools, further and higher education institutions, academies and free schools or service providers working on their behalf, National, Regional and Local Health Authorities, including National Health Service (NHS) Bodies NHS Trusts, Clinical Commissioning Groups (CCGs), NHS Trusts and Primary Care Trusts, other NHS entities, and any organisation providing a service to these bodies, Any local and Regional Authorities, including any arm's length organisations or service providers working on their behalf, Any service provider delivering services to any other Government Agency in the United Kingdom including, without limitation, the Ministry of Defence and the Highways Agency, Any supply chain member of Hyde or of any of the above organisations
Lot Information
Workstream A
This workstream consists of: A.1 Electrical Testing and Remedials - Domestic (works value up to PS3m), A.2 Electrical Testing & Remedials - Communal (works value up to PS3m) across four regional areas and AN - Electrical Testing & Remedials - All Elements (works value over PS2m) national. The four regional areas are: Region 1 - London, South East and East of England, Region 2 - South Wales and the South West, Region 3 - East and West Midlands, Region 4 - North Wales and The North of England and Region 5 - National. Bidders do not have to be able to cover ALL areas within a region to bid for that region, but will be asked to complete a Postcode Checker form to declare which areas within that region they are currently delivering work. All works relevant and appropriate to the above workstreams will be included, examples of the types of work expected are as set out in the specifications, but additional relevant work may be included at the discretion of the authorised user and may include servicing, maintenance and installations as required by authorised users. The regional lots will cover call offs up to PS3m (including VAT), the national lot will cover call offs over PS2m (including VAT. There is an intentional cross over between the 'up to' and 'over' lots, giving authorised users the flexibility to call off from either lot at their discretion. Bidders should note that the 'up to' and 'over' values are PER call off and not annual values, so for example if an authorised used wants to call off a 10-year contract with an annual value of PS400,000 this would only be available to call off under the 'over' national lot. As set out in the procurement documents, specifically the Lot Bidding Form, bidders can bid for any or all of the regional lots OR the national lot for each specific workstream - but not both the regional and national lots for a specific workstream. Renewal: Hyde reserves the right to extend the Framework Agreement for a further period of up to two (2) years beyond the initial four-year term. A longer framework term may therefore be required to maintain service continuity, maximise value for money, avoid unnecessary mobilisation and transition costs, and support the effective delivery of Hyde's compliance strategy. Workstream HThis workstream consists of: H.1 Playground Inspections (works value up to PS3m) H. 2 Playground Maintenance (works value up to PS3m) across four regional lots and HN Playgrounds - All Elements (works value over PS2m) national All works relevant and appropriate to the above workstreams will be included, examples of the types of work expected are as set out in the specifications, but additional relevant work may be included at the discretion of the authorised user and may include servicing, maintenance and installations as required by authorised users. The regional lots will cover call offs up to PS3m (including VAT), the national lot will cover call offs over PS2m (including VAT. There is an intentional cross over between the 'up to' and 'over' lots, giving authorised users the flexibility to call off from either lot at their discretion. Bidders should note that the 'up to' and 'over' values are PER call off and not annual values, so for example if an authorised used wants to call off a 10-year contract with an annual value of PS400,000 this would only be available to call off under the 'over' national lot. As set out in the procurement documents, specifically the Lot Bidding Form, bidders can bid for any or all of the regional lots OR the national lot for each specific workstream - but not both the regional and national lots for a specific workstream. "description": "This procurement relates to the establishment of a framework for the provision of various compliance services across the property and housing sector. The framework is designed to support Hyde Housing Association (Hyde) and other public sector bodies in accessing high-quality services to deliver their compliance servicing, maintenance and installation programmes. The framework will offer services regionally and nationally, with an estimated value of PS2,688,000,000 exc VAT (PS3,225,600,000 inc VAT) over its possible six-year term (an initial term of four years with the option to extend for a further two years). Individual framework lots will have anticipated values, but all lots will draw from the single aggregate total framework value. All values shown are estimates only and do not guarantee expenditure. Call-off contracts awarded under this framework may be extended beyond the initial contract term. The maximum duration of any individual call-off contract, including any extensions, shall not exceed 15 years. The Authorised Users may exercise the right to extend at their sole discretion, provided that written notice is given to the Framework Supplier no later than 3 months prior to the expiry of the then-current term. Extensions are subject to satisfactory performance, continued need, and budgetary approval. The framework consists of 141 lots covering specific workstreams across four regional areas (Region 1. London, South East and East of England, Region 2. South Wales and the South West, Region 3. East and West Midlands, Region 4. North Wales and the North of England) and a national region (Region 5). For each workstream, bidder are able to bid for a combination of regional lots or the national lot. The framework will be accessible nationally and will allow for both award without further competition, formerly direct award and competitive selection process, formerly mini competition under the Open Procedure, in accordance with the Procurement Act 2023 and associated Regulations and will be open to all UK public sector bodies (and others as detailed in the procurement documents and in the description below) to access via an Access Agreement between Hyde, the Supplier and Pretium Frameworks Ltd, who Hyde has appointed to administer the framework on their behalf. Pretium will act as the agent, as per the Procurement Act 23. Full details of the scope and requirements of the framework and the procurement process, including how to tender are included within the procurement and tender documents. Hyde anticipate appointing ten suppliers to each individual workstream lot (per region), and twelve suppliers to each national workstream lot, but reserve the right to adjust these numbers at their discretion as set out in the procurement documents, specifically the Lot Bidding Form. The Contracting Authority reserves the right to cancel the procurement and not to proceed with all or any part of the Framework at any stage of the procurement process. The Contracting Authority also reserves the right not to award the Framework. Neither the Contracting Authority nor any person on whose behalf of whom this procurement is undertaken is to be liable for any costs incurred by those expressing an interest or Tendering for this Framework. The Contracting Authority considers that this contract may be suitable for economic operators that are Small or Medium Enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement. It should be noted that neither Devonshires, Pretium or Echelon shall be responsible for any changes made to the documents without the approval or engagement of the authors of the relevant documents at or prior to call off stage.
